Enquiry concerning the parental kidnapping

On the 17th and 18th of December 2007, the CEED (Mr Karrer and Mrs Lavier) as well as Sabine and Pascal went to the EP in order to watch the proceedings of the LIBE meeting. We had an appointment with vice president Mc Millan Scott as well.

Mr Mc Millan Scott has sided in our favour in the field of child abduction. The problem is not solved, far from it. We asked for Mr Mc Millan Scott to speak, at the plenary of LIBE, on the 14^th of January. He accepted to do it.

We tried, too, to get some MeP interested in the story of our woes. Polish parents got the support of a Polish MeP. Same on the French side. Nothing, so far, on the Belgian side.

We mentioned to the Vice President that most of the amendments were useless, as long as we were dealing with a country – specifically Germany – whose laws were still from the dark years.We mentioned as well the risk created by laws giving the child the possibility of becoming the King-Child.

We documented our point of view with a document produced by the CEED, concerning the Jugendamt, and a letter from Walter Keim.

Concerning the amendments proposed by the MeP, they show that no-one is really aware of the German situation.

We asked MMS to request for opening of an enquiry regarding several problems created by Germany.

We specifically asked the enquiry to be made regarding the following points :

1 “the well being of the child” does not have the same meaning in the different countries of Europe and should be defined. Otherwise, Germany uses that notion for its own interest, and certainly not for the one of the child.

2 The dubious behaviour of the Jugendamt.

3 German family laws are incompatible with European family laws.

Concerning our own enquiry, concerning the amount of binational kidnapping, and the resolution of some of them : we started putting the datas together. The more, the “better”: please participate.

The Central Authorities were not helpful at all. As usual.

The most obvious which could appear at once was the lack of organization between the ministries.

It is almost impossible to give the exact numbers of binational kidnapping – because the CA’s do not want to inform and because… they probably do not know.

As we asked to dozens of CA’s, most of them did not answer. Two only did: the Spanish one in order to ask us to write in Spanish, the Swiss one (in German) in order to let us know that they would not give any info.

The same request for info was asked to the ministry for foreign affairs. No answer.

Various associations who are working in the field were asked as well. We know what the problem of those associations can be. We are hoping some answers will come.

Some personalities commented on our questions. They mentioned clearly that the binational kidnapping is strongly understated, either because of ignorance, or because of a political will.

Some journalists mentioned the difficulty they have in order to get info, regarding the matter.

The general feeling was that the CA wish not to give info : the less info, the smaller the problem…

In Belgium, we were helped by Zoé Genot (MP), by Ghislain Duchateau of Goudi, Sultana Kouhmane of sosraptsparentaux, Marie Breda of citoyens.stools. Thank you to all of them.

We are contemplating a demonstration, within the next few months, which may last one month. Sabine and Pascal would walk from Brussels EP to Strassburg EP, through Germany: we shall, through our action, support several points:

# the right of the child to have access to both his parents

# denunciation of parental alienation

# denunciation of the refusal of the judge to take a decision, in the family courts

# the problems of national and binational kidnapping

# Hooligan states

# …

We are considering an international signature campaign and are aiming at 1.000.000 signatures. The new Lisbon tready seems to consider that if the ordinary layman brings one million signatures concerning such or such problematic, a law will have to be discussed and voted. We may try to impose the law that a child needs both his parents.
